Heard the learned counsel for respective parties. The Original Application filed with the respondent was allowed and the Central Administrative Tribunal directed the petitioners to reinstate the respondent. In the year 2003, the respondent was 52 years of age. The order of Central Administrative Tribunal directed petitioners to reinstate the respondent is assailed in the present writ petition. This Court, vide order dated 19.11.2003, had refused the interim relief.

With the passage of time, the respondent has already attained the age of superannuation. It was also observed by this Court at the time of refusing interim relief that the candidate selected in place of the present respondent himself was not eligible. The reasons given by the Central Administrative Tribunal was also considered. 3.
