Learned counsel for the applicant submits that the applicant/original accused challenged the order passed by the Judicial Magistrate First Class, Kaij dated 18.08.2015 issuing process against the applicant accused for the offences punishable under sections 186, 506 of the Indian Penal Code and sections 3(1)(10), 3(2)(7) of the prevention of Scheduled Caste and Scheduled Tribes Act. This court, by order dated 24.08.2015 in Criminal Application No.4528/2015, granted ad interim relief in 1/2

However, on 25.08.2015, the learned Judicial Magistrate, First Class has committed the case to the Special Court, Ambajogai since the offences alleged to have been committed are exclusively triable by the Sessions Court. In view of this, the further proceedings in Special Case No. 18/2015 pending before the Special Court/Additional Sessions Court, Ambejogai are hereby stayed till next date of hearing in Criminal Application No.4528/2015.

In the light of above, the Criminal application No. 329/2016 is disposed of.
