Petitioners are aggrieved by the rejection of their stay application filed before the Divisional Commissioner in Appeal challenging the externment order.

Learned advocate for petitioners submits that there are only three offences registered against petitioners and there is no live link between the offences alleged against them. This aspect is not considered by the appellate authority while rejecting the stay application.

Learned APP, on the other hand, points out that the appeal filed by the petitioners is kept for final hearing on 29.01.2024.

In that view of the matter, it is not necessary at this stage to go into the merits of matter as the substantive appeal is pending before the learned Divisional Commissioner and the same is likely to be decided after hearing petitioners on 29.01.2024.

Writ petition is therefore disposed of by directing the appellate authority to decide the appeal filed by petitioners on or before 05.02.2024.
