ORDER:- 1.

Heard the learned counsel for the applicant - wife. On last date it was specifically observed that the matter would be worked out in the absence of respondent, if nobody appears.

The applicant - wife is seeking transfer of HMP No.201 of 2021 filed by the respondent - husband for getting divorce, from the Court of learned Civil Judge (Senior Division), Alibagh to the Court of learned Civil Judge (Senior Division), Biloli, District Nanded. It appears that the applicant is not having any independent source of income. Moreover, she is having minor daughter aged about one year, to look after. The distance between Biloli and Alibagh is of 650 kms. Thus, it appears that it would not be convenient to the applicant wife

(2) 952 MCA-30.2022.odt to travel such long distance for attending the dates at Alibagh, District Raigad. As such, considering the convenience of the applicant wife, following order is passed.

ORDER

(i) The application is allowed.

(ii) HMP No. 201 of 2021 is hereby transferred from the Court of Civil Judge (Senior Division), Alibagh to the Court of Civil Judge (Senior Division),, Biloli, District Nanded for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Biloli on or before 25th January 2023.

(iv) The application is accordingly disposed of.
