PER COURT :- This is an application for condonation of delay and for recalling of order dated 4.11.2023, passed by this Court in criminal writ petition No. 1218 of 2023, which was dismissed in absence of the petitioner and his advocate.

Learned advocate for the petitioner submits that due to unavoidable circumstances, he could not mark the matter and the proceeding went unattended. Consequently, the petitioner has not got opportunity to argue the matter in respect of the contention raised in the writ petition.

Learned A.P.P. for the respondent State strongly objected the application.
