Heard the learned counsel appearing for the petitioner and learned AGP appearing for the State and its officials and learned counsel appearing for the respondent Nos. 2 and 3.

There is innocuous prayer in the petition in as much as application filed by the petitioner on 25.09.2017 with respondent No.3 has not taken cognizance and consequently the said grievance raised by the petitioner has not been redressed. In that view of the matter we direct the respondent Nos.2 & 3 to take the decision on the application dated 25.09.2017 [Exh.D Page-22] filed by the petitioner, if already not taken, on its own merits and keeping in view the service record of the petitioner

( 2 ) wp1238.18 and Government Resolution dated 11.11.2011 issued by the School Education Department, Government of Maharashtra [Exh.C Page-19], on its own merits as expeditiously as possible, however within 10 weeks from today and communicate the said decision to the petitioner. 3.

We make it clear that we have not expressed any opinion on merits of the contentions raised in the said application and it is for the respondent No.3 to take the appropriate decision.

With the above observations the petition stands disposed of.

Needless to observe that, it would be open for the respondent No.3 to issue notice to the petitioner and the concerned respondent, if respondent No.3 wish to hear them.
