We have perused the earlier order of the Education Officer dated 10.2.2022 in response to the proposal of the Management dated 13.10.2021. According to the Management, a fresh proposal was forwarded dated 14.2.2022 putting forth the latest position of the surplus teachers before the Education Officer. Grievance of the Petitioner is that he is awaiting approval for his transfer from the partly aided establishment to the fully aided establishment. 2.

The learned Advocate representing the Zilla Parishad khs/Jan.2024/903

- 2 - submits that the fresh proposal was actually forwarded within 4 days of the earlier order of rejection.

We find that, as on date, almost 2 years have lapsed after the fresh proposal dated 14.02.2022 has been tendered. The Education Officer can consider the latest position of surplus teachers and deal with the proposal in the light of the relevant records which are updated till 30.01.2024. Based on such records, a fresh order can be passed. 4.

In view of the above, this Petition is disposed off. Respondent No.4 would proceed in terms of the above directions and after duly scrutinizing and verifying the records, pass a reasoned order within a period of 90 days from today.
