VERSUS
DR.ANJALI MADHUSUDAN DESHPANDE AND ANR ...
Advocate for the Petitioners : Shri Sharad V. Natu. Advocate for Respondent 1 : Shri Deshmukh Prashant K.. ...
CORAM: RAVINDRA V. GHUGE, J.
DATE :- 07th May, 2018 Per Court:
Shri Deshmukh, learned Advocate appearing on behalf of Respondent No.1/ original Appellant before the University and College Tribunal, Aurangabad in Appeal No.BAMU-16/1999, tenders the original pursis issued by the said Appellant dated 30.07.2017 by which, the said Appellant has declared that she does not desire to pursue her claim of reinstatement and back wages against the Petitioner/ Management. The original pursis dated 30.07.2017 is taken on record and marked as "X" for identification.
The learned Advocate for the original Appellant, therefore,
*2* 4wp2042o00 submits that this petition can be disposed of since the original Appellant does not desire to seek the execution and implementation of the impugned judgment of the University and College Tribunal dated 30.04.2000 delivered in the appeal preferred by her. The learned Advocate for the Petitioner/ Management agrees for the disposal of this petition.
Considering the above, this Writ Petition is disposed of by recording the statement of Respondent No.1/ original Appellant and as a consequence, the impugned judgment of the University and College Tribunal would lose it's efficacy and would not be open for seeking execution and implementation.
Rule is discharged.
In view of the above, the pending Civil Application No.6044/2018 does not survive and stands disposed of. kps (RAVINDRA V. GHUGE, J.)
