The applicant is seeking regular bail in Crime No.I-150/2015 registered at Soygaon Police Station, Dist. Aurangabad, for the offences punishable under Sections 354-D, 306, 452, 109, 506 read with sec.34 of Indian Penal Code and under Sections 11 and 12 of the Protection of Children from Sexual Offences Act 2012. 3.
It is claimed by the complainant, Atul that his younger sister Durga who was studying in 12th Standard has committed suicide alleging abetment by the present applicant.

Learned Counsel for the applicant in the above background submits that the custodial interrogation of the applicant is already over and the charge-sheet is filed, hence his further detention for the purpose of investigation is not necessary. He would then add that deceased Durga was in love with the present applicant, as is apparent
Cri.Appln.349/2016 from the various letters to that effect written by the deceased in favour of applicant. According to him, as such, the applicant cannot be held responsible for the crime in question. 5.
Learned A.P.P. opposed the application in view of the material that is collected during the investigation, which according to him, depicts prima facie involvement of the applicant in commission of the crime in question.

Perused the investigation papers. In the background of the fact that deceased Durga was in love with the present applicant and perhaps, it is out of same, the deceased Durga might have committed suicide. In my opinion, further detention of the applicant is not necessary in view of the fact that the investigation is already over. 7.
As such, Criminal Application stands allowed. The applicant be released on bail in Crime No.I-150/2015, registered at Soygaon Police Station, Dist. Aurangabad, for the offences punishable under Sections 354-D, 306, 452, 109, 506 read with sec.34 of Indian Penal Code and under Sections 11 and 12 of the Protection of Children from Sexual Offences Act 2012, upon furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount.
