Considering that two identical writ petitions Nos. 3219 and 4658 of 2011 have been partly allowed by judgment dated 27.10.2016, both the learned Advocates for the respective sides submit that this petition would be covered by the said judgment.

Considering the above and on perusing the facts of the case in hand and the earlier judgment of this Court dated 27.10.2016, this petition is partly allowed for the same reasons and the petitioner is directed to pay compensation of Rs.60,000/- to the respondent - Govardhan Sukhadeo Korde, within twelve weeks from today. 3.

In the event, the petitioners fail to pay the said compensation within the time frame, both the respondents / employees would be entitled for interest at the rate of 6% per annum from the date of the

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 2554 OF 2009 awards till it's actual payment and the said amount of interest shall be paid from the salary of the Executive Engineer, Kukadi Project Land Development Division No.1, Ahmednagar. Needless to state, the amount of interest shall not be paid from the State exchequer. 4.
