Heard learned Counsel for the parties.

Learned Counsel for appearing for the petitioner makes an oral prayer so as to add the Education Officer (Secondary), Zilla Parishad, Nanded as party respondent. Prayer granted. Amendment to be carried out forthwith.

Learned AGP waives service for added respondent. Learned Counsel for the petitioner submits

1007.16wp that, during the pendency of this petition, the respondent No.2 has already passed an order allowing correction in date of birth in primary school record of the petitioner. The learned Counsel submits that, the petitioner will approach the added respondent within two weeks from today for correction of date of birth in the secondary school record. Upon filing such an application by the petitioner, the added respondent and also the concerned school, without raising an objection that the petitioner has left the school, shall take decision, keeping in view the provisions of Clause 26.4 of the Secondary School Code, as expeditiously as possible; however, within six weeks from filing of such application by the petitioner.

Petition stands disposed of on above terms.
