ORAL ORDER :- 1.

The Petition is filed for giving direction to the respondents to allot an agricultural land to the petitioner as he is a Project Affected Person. His land is acquired for Jayakwadi Project. The submissions made show that the Deputy Collector (Rehabilitation) had asked the petitioner to comply few things by giving letter dated 05.03.2013. Today the learned Counsel for the petitioner produced on record a copy of correspondence

(2) WP No.610/2013 made by the petitioner with the Deputy Collector (Rehabilitation). This letter dated 12.06.2013 shows that the petitioner supplied the documents which were to be complied with as per the letter of Deputy Collector (Rehabilitation) dated 05.03.2013. Thus, according to learned Counsel for the petitioner, the compliance is made by the petitioner, but no further steps are taken.

The learned A.G.P. submitted that one land bearing Gut No.71/1 is already allotted to other person viz: Nanasaheb Bhadke by the order dated 06.03.2013. The record produced today shows that the petitioner has given other options like Gut Nos.925/1, 1731/2 and 166/11. In view of this circumstance it is now open to the Deputy Collector / Authority to consider the representation and take a decision on it. Learned A.G.P. is not disputing that such record was received by Deputy Collector with covering letter dated 12.06.2013. If it is not received, the copy can be produced by the petitioner and the Authorities to take decision in the matter within three months from the date of this order.

With the aforesaid direction, the petition is allowed and disposed of.
