VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ANOTHER Mr.C.R.Thorat, Advocate for the petitioner.

( CORAM : MANGESH S. PATIL AND PRAFULLA S. KHUBALKAR, JJ. ) DATE : JANUARY 20, 2025 PER COURT :
1.
The petitioner is before us as the respondent / Scrutiny Committee dismissed his claim in default.
2.
We have heard both the sides.
3.
One wonders when the Respondent Committee is merely conferred with a quasi judicial power in respect of tribe claims, could act so arbitrarily as to dismiss the claims in default when it is not an adversarial litigation, even when the Committees across the State are khs/Jan.2025/930
- 2 - stated to be overburdened with thousands of proposals and is not even having sufficient members of the Committees to decide the proposals. 4.
The writ petition is allowed partly. The impugned order is quashed and set aside and the matter is remitted back to the Committee for decision afresh in accordance with Law by extending an opportunity to the petitioner to contest the petition. The petitioner shall appear before the Committee on 27.01.2025 and the Committee shall thereafter decide the proposal within 4 weeks. ( PRAFULLA S. KHUBALKAR, J.) ( MANGESH S.
