Present application has been filed for getting the delay of 778 days condoned in filing first appeal. The applicant is the original claimant who intends to challenge the judgment and award passed by the learned Reference Court for enhancement. Learned AGP take strong objection on the ground that the reasons stated for condonation of delay are not sufficient and reasonable. 2.

Taking into consideration the fact that the applicant is an agriculturist, illiterate person and coming from rural area therefore, delay stands condoned.

Civil Application stands allowed and disposed of accordingly.

It is clarified that the applicant will not be entitled to get interest for 778 days in case of success in his appeal. 5.
