Heard learned Counsel for the petitioner, learned AGP appearing for the State and learned Counsel for Respondent No.2. It is not in dispute that, the proposals of the petitioner seeking permission to open Sr. College has been favourably recommended by the respondent No.2 to the State Government. The said proposals were for the academic year, 2013-14. In similar set of facts, the
Division Bench of this Court in the case of Rajureshwar Shikshan Prasarak Mandal, Takli Kolate, Tq. Phulambri vs The State of Maharashtra and ors. (Writ Petition No.12395 of 2015 with connected petitions) vide order dated 28th December, 2015, directed the State Government to consider the proposals submitted by the petitioners therein for the academic year 2015-16 to be the proposals submitted for the academic year 2016-17 without asking the petitioners to submit the fresh proposals or fresh deposits, along with the other proposals which may be received to the respondents in pursuance of the advertisement published in daily "Lokmat"
on 14.12.2015 by the respondents.
We adopt the same course and direct the respondent / State Government to consider the proposals submitted by the petitioners and recommended by the respondent No.2 for the academic year, 2015-16 to be the proposals submitted for the academic year 2016-17 without asking the petitioners to submit the fresh proposals or fresh deposits.
We make it clear that, the said proposals are to be considered while
considering the other proposals received by the State Government for the academic year, 2016-17.
In addition to communication of the order by the petitioners to respondent No.1, the learned AGP to communicate this order to the respondent No.1 through office of the Government Pleader, High Court of Bombay, Bench at Aurangabad. On above terms, all the three petitions stand disposed of. Parties to act upon authenticated copy of this order.
