Heard learned counsel for applicant -wife, who has requested for transfer of proceedings bearing Petition A- No. 40/2020 and proceeding bearing Petition F. No.10/2021 which are filed by respondent -husband respectively for getting divorce on the ground of cruelty and divorce by mutual consent.

The learned counsel for the applicant -wife submitted that in the petition for getting divorce by mutual consent the respondent - husband had given a cheque of Rs. 11,50,000/- towards the full and final settlement, but it was dishonoured. Since then the respondent - husband is harassing the applicant -wife by keeping pending the aforesaid proceedings at Family Court, Latur.

Though the notice of final disposal was served upon the respondent -husband on 04.04.2022 as reflected from postal tracking report annexed to the affidavit of service, he did not care to appear there. In view of the same and for the reasons mentioned in the application, following order is passed :

ORDER

(i) The application is hereby allowed and the Petition ANo.40/2020 and Petition F. No. 10/2021 pending before the Family Court at Latur are hereby transferred to the Family Court at Aurangabad.

(ii) After receiving the aforesaid proceedings, the learned Family Court, Aurangabad re-issue notice to respondent - husband.

(iii) Application is accordingly disposed of. (SANDIPKUMAR C. MORE) JUDGE .....
