IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2210 OF 1997 Nemichand Birdichand Ajmere Petitioner

Versus

Smt.Menakaraje Yeshwantrao Pawar and others Respondents Mr.A.H.Kasliwal, Advocate for the petitioner. Mr.S.D.Kulkarni, Advocate for Respondents No.1 & 2. Mr.S.R.Yadav, AGP for Respondent No.3.

CORAM : RAVINDRA V. GHUGE, J.

DATE : 18/07/2019 PER COURT :

The petitioner is aggrieved by the order dated 28.01.1997 (the date is not mentioned in the prayer clause) in Proceeding No.MRT.AH.II.8/94 (TNC.B.63/94) Pune-1, by which the Revision filed by the petitioner has been dismissed. It has been concluded that considering the average yield from the land in the suit property and the market price, the rent has been fixed. Since the issue is more than 22 years old and originally the price was fixed on 23.10.1978, this petition is rendered infructuous and hence, disposed off.

- 2 - It is, however, made clear that if the petitioner has any grievance surviving pursuant to subsequent events, he would be at liberty to take recourse to a remedy for redressal of his grievance, as is permissible in law.

3.

Rule is discharged.
