The petitioners, by filing this petition, assert that though they were working as Radical Treatment Workers on temporary basis, they were denied appointment to the post of Health Worker (Male). This action of the respondents, according to them, was illegal, arbitrary and violative of the provisions of Article 14 of the Constitution of India.

By way of writ petition No. 1760 of 2004, similar issue came before this Court and this Court dismissed the said writ petition on merits, by recording reasons as to how the petitioners or the persons in petitioners' position were not entitled to appointment. The said
wp1755.04 -2judgment is now shown to us. On perusal of the same, we are convinced that this petition is also liable to be dismissed in terms of the said judgment dated 10.2.2005, delivered in writ petition No. 1760 of 2004.

The Writ petition is accordingly dismissed. Rule discharged. No costs.
