PER COURT:

1] The petitioner is purchaser of a vehicle for which finance was given by TATA Finance. As the original debtor who had taken the loan had not repaid it, the vehicle was taken over by TATA Finance and it was sold. This vehicle was purchased by present applicant in On-line Auction. There is no grievance of the original debtor/owner that the vehicle was sold at much less price than the price which the vehicle could have fetched in market. 2] In view of the complaint given by the original debtor Yogesh Shinde, police were making enquiry. Report given by one Mr. Anil D. Kumbhare, S.P. Aurangabad Rural, shows that no false case would be registered against the petitioner.

3] In view of this undertaking, present proceeding is disposed of. [SMT. I.K. JAIN] [ T.V. NALAWADE] JUDGE JUDGE.
