It is contention of the learned Counsel for the petitioner that the investigation is not done in a proper manner and accused persons are not arrested and the Investigating Officer should be directed to arrest the accused.

In our opinion, if the Investigating Officer is confident that the accused persons would make themselves available for investigation, giving such direction to arrest the accused, is unwarranted. It

99.15crwp may amount to interference in the investigation. Investigation, arrest of accused fall within the domain of the Investigating Officer. Therefore, we decline to accede to the oral prayer of the applicant.

We direct the concerned Investigating Officer to carry out the investigation expeditiously and in case, there is enough material, to take further steps. Petition stands disposed of, accordingly. (A.M. BADAR, J) (S.S. SHINDE, J) kadam/
