IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.1522 OF 2003 EXECUTIVE ENGINEER,M S E B BEED AND OTHERS

VERSUS

MADHUKAR GOVINDRAO CHADAR ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 08th MAY, 2019.

...

PER COURT :

1.

None for the respondent.

2.

It is informed that the learned Advocate for the petitioners has passed away and the petitioner establishment has not engaged a new advocate.

3.

Notwithstanding the above, I find that this petition can be disposed off since an interlocutory order is challenged in this petition. The Labour Court, Aurangabad had passed an order dated 05/02/2002 allowing the application for interim relief Exhibit U-2 in complaint (ULP) No. 77/2001. This Court admitted the petition by order dated 12/01/2004 and stayed the impugned order. In addition thereto, the Labour Court

143-wp-1522-03.odt was directed to dispose of the complaint on or before 30/04/2004.

4.

Considering the above, this petition is disposed off as being infructuous. Nevertheless, in the event the Labour Court, Aurangabad has still not decided complaint (ULP) No. 77/2001, it shall decide the said complaint as expeditiously as possible and in any case on or before 31/12/2019 and the order passed by this Court on 12/01/2004 staying the interim order dated 05/02/2002, shall continue till then. Needless to state, if the ULP complaint is already decided under the directions of this Court dated 12/01/2004, the interim relief granted by this Court would lose its efficacy. 5.

Rule is discharged.
