1] Heard learned counsel for the applicant, the learned APP for the respondent-State and learned counsel for the Informant. 2] The applicant is apprehending arrest in connection with Crime No.0384/2024, dated 08.08.2024, registered at Shivaji Nagar Police Station, District Beed, for the offences punishable under Sections 115(2), 118(1), 119(1), 119(2), 189(2), 190, 3(5), 333, 351(2), 351(3), 352 of the BNS.
3] The allegations against the applicant is that he along with others assaulted the informant, on 08.08.2024, at 10:30 p.m. The specific allegation as far as the present applicant is concerned, he took hockey
2 912 stick from another person and assaulted the informant on his eye to get some money from the informant.
4] Today, the informant is present in the court and he has filed the affidavit that he is resolving the dispute with the applicant. The affidavit is taken on record. It is also stated that 2 of the accused persons are already granted bail.
5] Considering the same and considering also that the affidavit is filed by the informant, this application needs to be allowed. 6] In view of the above, the application is allowed in the following terms :
i] In the event the applicant is arrested in connection with Crime No.0384/2024, dated 08.08.2024, registered at Shivaji Nagar Police Station, District Beed, for the offences punishable under Sections 115(2), 118(1), 119(1), 119(2), 189(2), 190, 3(5), 333, 351(2), 351(3), 352 of the BNS, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the police station as and when required by the Investigating Officer.
3 912 iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 7] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 9] The application stands disposed of.
