DATE : 20th January, 2025 Per Court :- The petitioner is awaiting a decision of the Scrutiny Committee for validation of the tribe claim stated to have been forwarded by the Zilla Parishad way back in the year 2013. 2.

On a query, the learned advocate for the petitioner informs us that the petitioner had never been to the Committee with necessary documents calling upon it to decide his proposal. After he is terminated and waiting for provisional pension, is now seeking direction to the Committee to decide the proposal. 3.

The learned AGP, on instructions, submits that except the communication being relied upon at page No.20

*2* 63wp962o25 purportedly forwarding the proposal to the Scrutiny Committee, nothing could be traced.

We grant liberty to the petitioner to approach the Scrutiny Committee and place on record all the documents on 27.01.2025. The Scrutiny Committee shall thereafter undertake the exercise, scrutinize the proposal if necessary by reconstructing it with the assistance of the petitioner and decide it as expeditiously as possible and in any case within sixteen weeks from the date of his appearance.

It is also being submitted by the learned advocate for the petitioner that he does not possess the original tribe certificate which was submitted to the employer Zilla Parishad and was a part of the proposal forwarded by it. 6.

Even if the Scrutiny Committee is not able to trace out the original file/ proposal, it shall take appropriate decision in respect of permitting the petitioner to obtain a duplicate certificate from the concerned competent authority. 7.
