Order :- Learned counsel for the appellant submits that, the appellant is no more and he passed away on 10th July 2016. His heirs are not interested to pursue the appeal. In such circumstances, he prayed to pass suitable order in appeal. 2.

Death certificate produced on record accompanied with the letter of the concerned District Judge, Aurangabad dated 28-07-2017 demonstrates that the appellant is reported to be dead. His legal heirs are not ready to come forward to pursue the appeal.

In such circumstances, there is no propriety to keep the appeal alive since appellant is dead.

In the light of above, appeal stands abated and disposed of accordingly.
