It has been reported that one lawyer Mr. P. K. Joshi stopped practicing law. It was informed to the Court that the learned counsel Mr. R. R. Mantri for the appellants is no more. Hence, this Court by order dated 20.06.2023 had issued the notices to the appellants on court motion. The notices were served upon the appellants. But, they did not appear on 01.08.2023. Therefore, the Court granted them six weeks time to appear and listed the matter on 12.09.2023. Thereafter, the matter listed on weekly board of final hearing. 3.

Today, the matter has been again called. But, none present for the either of the parties. This indicates that the appellants have lost the interest in the litigation. Second Appeal is pending since 1995.

For the above reasons, the second appeal stands dismissed for default.
