Heard learned counsel for the applicant and learned APP for the State.

The allegation against the applicant is that he provided the accommodation to confine the person kidnapped. The alleged amount of Rs.80,000/- has been recovered from him. Except his role to provide the accommodation, there are no other allegations. The applicant did not actually participated in kidnapping. The applicant has a case that he did not know that the said person was kidnapped; however, he was knowing the other co-accused. Hence, he gave them a shelter. In the light of the facts of the case and the allegations levelled against the applicant, it would be inappropriate to keep him behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Ankush Pandurang Chavan, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.342 of 2022, registered with Nanalpeth Police Station, District Parbhani for the offence punishable under Section 323, 364-A, 34 of the Indian Penal Code, on the condition that he shall not tamper with the prosecution evidence.
