Shri Choudhari, learned counsel for the petitioner states that respondent no.4 though junior to the petitioner is promoted as a Head Master. The learned A.G.P. states that in that case the petitioner has a remedy under Section 9 of the M.E.P.S. Act. In view of that, though Mr. Choudhari, learned counsel for the petitioner sought to canvass submissions on merits, we are not inclined to consider the same.

Writ petition is disposed of with liberty to the petitioner to avail the alternate remedy available to him in law. In that case all the contentions are kept open. If the petitioner has any grievance with regard to the approval to the appointment of the petitioner, the petitioner may take appropriate steps. No costs.
