The Petitioner is aggrieved by the judgment and award of the Labour Court dated 31.08.1995 by which, though his Reference (IDA) No.37/1993 has been partly allowed and he has been granted reinstatement with continuity in service with 25% back wages, 100% back wages have been denied.

*2* 906.wp.2917.97 Learned Advocates for the respective sides indicate from the order dated 04.12.1998 delivered in Writ Petition No.5575/1995 (M/s Kemp & Company Limited vs. Chindhu Waman Badgujar) that the Respondent herein had also challenged the same judgment before this Court in Writ Petition No.5575/1995. As the matter was settled between the parties by the Compromise Terms Exhibit X dated 04.12.1998, Writ Petition No.5575/1995 filed by the Respondent/ Management was disposed of by modifying the impugned award in terms of the compromise Exhibit X.

In the light of the above, this Writ Petition does not survive and stands disposed of in the light of the order dated 04.12.1998 delivered in Writ Petition No.5575/1994.

Rule is discharged.
