This application is for condonation of delay in setting aside abatement and bringing legal heirs on record. A delay of 2867 days is sought to be condoned on the grounds stated in paragraph nos.4 to 9 of the application. Applicant No.3/Ranjit Anant Jadhav died. He is survived by Applicant No.3A in the cause title of the application. Respondents do not dispute the entitlement of the Applicant No.3A to be substituted. In fact it is the obligation of the respondents who are the appellants to file such application. For the reasons stated in the application, I am inclined to condone the delay and permit to substitute deceased Applicant No.3 by Applicant No.3A. 2.

Civil application is allowed in terms of prayer clause 'B', 'C' and 'D'.
