Learned Advocate for the respondent/employee Mr.Bandu Dhrupatrao Dhakne submits on instructions that his objection with regard to the inclusion of the Management Representative in the Enquiry Committee, is restricted as against Mrs.Padma Vinayak Wagh and Mr.Vinayak Wagh. The enquiry has been set aside by the School Tribunal on the count that Mr.Vinayak Wagh was Member of the Enquiry Committee.

He, therefore, submits that the Management may opt for any other person from amongst their trustees to be included in the Enquiry Committee when the same would be reconstituted.

In the light of the statement made as above, the learned Sr. Advocate Mr.Dixit submits on instructions that the petitioners desire to withdraw this petition so as to proceed with the disciplinary enquiry as directed by the School Tribunal.
