The question that rises in this petition is whether the petitioner was entitled to benefit of compassionate appointment to his next of kin as per the Government Resolution dated 23rd August, 1996? 3.

The petitioner admittedly got retired after he reached the age of 56 years due to ailment. He belonged to Class-C employee of Zilla Parishad. As per Government Resolution dated 23.08.1996 if a Class 'C' employee get retired due to ailment prior to age of 56, his next of

( 2 ) wp3772.99 kin would be entitled to appointment on compassionate ground. Since the petitioner's case does not fall within the parameters of the Government Resolution, the petitioner is not entitled to such benefit.

Accordingly, the petition stands disposed of. Rule discharged.
