The petitioner is aggrieved by the judgment and award dated 31/08/1995 by which, though his Reference (IDA) No.36/1993 has been partly allowed and he has been granted reinstatement with continuity in service with 75% back wages, 100% back wages have been denied.

Learned Advocates for the respective sides indicate from the order dated 04/12/1998 delivered in WP No.5574/1995 that the respondent herein had also challenged the same judgment before this Court in WP No.5574/1995. As the matter was settled between the parties by the compromise terms Exhibit "X" dated 04/12/1998, WP No.5574/1995 filed by the respondent/Management was disposed of khs/NOV.2016/2002-d

by modifying the impugned award in terms of the compromise Exhibit "X".

In the light of the above, this petition does not survive and stands disposed of in the light of the order dated 04/12/1998 delivered in WP No.5574/1994.

Rule is discharged.
