We have heard the learned counsel for the respective sides in this Petition as well as the Civil Application.

Issue before us is regarding the appointment of the petitioner as Assistant (Junior) in the Maharashtra State Road Transport Corporation.

The learned Advocate for the MSRTC makes a statement on instructions and the affidavit filed, that petitioner no.2, in order of merit, is above petitioner no.1. As a vacancy was available to appoint her, petitioner no.2 has been appointed. The moment another vacancy occurs, the petitioner no.1 would be appointed. Petitioner no.1 is satisfied. 5.

Considering the above statement, this Petition is disposed off.
