The petitioner is challenging the validity of the caste certificate granted in favour of the respondent No. 7 by the concerned scrutiny committee.

The petitioner's husband had submitted an objection under Section 7 of the Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes(VimuktaJatis),Nomadic Tribes, Other Backward Classes and Special Backward Category(Regulation of Issuance and Verification of) Caste Certificate Act, 2000. The learned advocate for the petitioner as also the learned advocate for the respondent No. 7 are unanimous that pursuant to such objection an enquiry was undertaken but has not been finally concluded albeit a vigilance report was solicited and both the sides were also heard.

We dispose of the writ petition by directing the respondent Nos. 3 to 5 1/2

952 WP 2087 OF 2020.odt to take decision on the complaint as early as possible and in any case within eight weeks from today, after extending an opportunity of being heard to both the sides.

All the issues are kept open including maintainability of the objection.
