Admittedly, the respondent No. 2 in the first appeal - Shashikala has died. The legal heir of deceased respondent No. 2 is already on record as respondent No. 4. In the circumstances, the delay in filing the present application is condoned. For the reasons stated in the application, the same is allowed in terms of prayer clause (C). Necessary amendment be carried out within a period of two weeks from the date of this order.
