This is an application seeking stay to the conviction. The applicant is convicted by the learned Additional Sessions Court in Special Case (ACB) No. 02/2015 for the offences punishable under Sections 7, 13 (1) (d) r/w Section 13 (2) of the Prevention of Corruption Act. His sentence is already suspended. The appeal is pending.

Learned A.P.P. points out that, in view of the judgment of the Hon'ble Apex Court in a case of K. C. Sareen Vs. C.B.I., Chandigarh, reported in AIR 2001 SCW 3320, the criminal application be rejected.

In view of the judgment in a case of K. C. Sareen (supra), this Court finds that, no case is made out to stay the conviction. The criminal application is therefore rejected.
