The petitioner prays for withdrawal of this petition so as to be able to move an application in RCS No.521/2012 for seeking vacating of stay granted, u/s 10 of the CPC, by which the said suit has been stayed.

In the light of the said statement, this petition is dismissed as withdrawn, with liberty as prayed for. In the event, the petitioner makes an application for vacating the stay u/s 10 in RCS No.521/2012, the said application shall be decided by the concerned authority strictly in accordance with Law and keeping in view that this Court has not made any observations as regards the merits of the proposed application as contended in this petition.
