The applicants are seeking permission to bring themselves on record, being the legal representatives of Respondent No.1- sole claimant Amar Raosaheb Jagtap in the appeal by condoning delay of 184 days.

Admittedly, Amar Jagtap died on 18.04.2022 and considering right to defend, his legal heirs are to be brought on record.

As such, the application stands allowed in terms of

{2} prayer clause {B} by condoning the aforesaid delay. The Stateacquiring body to carry out the amendment forthwith. Civil Application is disposed of.

Since the State-acquiring body has deposited entire amount of compensation, the application is made absolute in terms of prayer clause {B) and disposed of.

{4} CIVIL APPLICATION NO.2608 OF 2023 IN Amar Raosaheb Jagtap (died) through L. Rs.

The applicants are seeking withdrawal of entire amount of compensation which has been deposited by the State acquiring body.

This Court, vide order dated 17th January, 2023, in connected matters, has already permitted the applicants therein to withdraw 75% of the deposited amount. As such, the applicants herein are permitted to withdraw 75% of the deposited amount along with

{5} proportionate interest accrued thereon by furnishing usual undertaking to the satisfaction of Registrar (J) of this Court. The remaining amount be invested in FDR, in any Nationalised Bank, on yearly renewal basis till fnal disposal of the appeal.

Civil Application is disposed of.
