Heard the learned APP for the State.

This is an application seeking condonation of delay in filing an application seeking leave to appeal challenging the judgment and order passed by the learned Sessions Court, Ahmednagar in Sessions Case No.109/2014 dated 31.08.2014.

For the reasons assigned in paragraphs 2 and 3 of the Criminal Application, the delay of 41 days deserves to be condoned in the interest of justice.

*2* 928.cr.appln.411.16 Hence, the Criminal Application is allowed in terms of prayer clause (B), which reads thus:- "(B) Delay of 41 days caused in filing Appeal against the order of acquittal passed by the learned Assistant Sessions Judge, Ahmednagar in Sessions Case No.109/2014 dated 31.08.2015 may kindly be condoned."
