The petitioner seeks benefit of Government Resolution dated 2nd September, 1989 claiming second time bound promotional benefits applicable to 20% of the members of the staff. According to Mr. Awate, the petitioner is entitled for the benefit of the second time bound promotional scale. It was allotted to one Mr. Kolte erroneously because he was also promoted as Headmaster in the year 2008. Learned counsel for the respondent Institution submits that Mr. Kolte was entitled for the benefit on 15.06.2005.

The Management may forward the proposal of the petitioner for the benefit of the Selection Grade pay scale as per the Government Resolution dated 2nd 1/2

The Institution/Management may put forth its noting on the said proposal. The Education Officer shall, thereafter, take decision upon the said proposal after hearing the petitioner and the respondents herein, expeditiously preferably within six months from the date of receipt of the proposal. The proposal shall be forwarded by the Management within one month from today.

Writ petition disposed of. No costs.
