By this application, the applicant seeks suspension of sentence of life imprisonment imposed on him by learned Sessions Judge, Aurangabad in Sessions Case No. 213/2020. 2.

Heard learned advocate for the applicant and learned A.P.P. for the State. Perused record.

The trial Court has convicted the applicant on the basis of circumstantial evidence. There is recovery from the applicant. So also DNA report confirms the fact of commission of rape by the applicant on deceased/victim. Injuries on the person of accused further prove his presence at the time of incident.

On appreciation of evidence, the trial Court has held that the prosecution has proved chain of circumstances which points to the guilt of accused.

We do not find any plausible reason to prima facie disagree with the reasoning adopted by the trial Court. This is not a fit case for grant of suspension of sentence. 6.

The application, is therefore, rejected.
