The learned counsel for the Applicant submits that though the Respondent / acquiring body has deposited the entire amount under award before the Reference Court, the Reference Court is not permitting the Applicant to withdraw the amount since the record and proceedings is called in this appeal. The learned counsel submits that the Respondent / acquiring body has not preferred any appeal and only the Applicant / original Claimant has preferred this appeal for enhancement of compensation.

Mr. M. V. Deshpande, learned counsel, on instructions, submits that the Respondent / acquiring body has not preferred any appeal. In view of the above, the learned Judge of the Reference Court may consider the request of the Applicant / Claimant for withdrawal of the compensation. Civil application stand disposed of. [ V. K.
