Learned counsel for the Appellants submits that legal representatives of Respondent No.5A are already on the record as Respondent Nos.5B to 5D and so there is no necessity of making application and giving notices to them. He submits that other side has informed about the death of Respondent No.5A recently.

Learned counsel for the Appellants submits that when the counsel, who is representing other Respondent, had informed that there is mistake committed in describing Respondent No.5C, the correction was made and again

-:(2):- paper publication was given to Respondent No.5/C. Nobody has turned up for Respondent Nos.5B to 5D. 3.

In view of this circumstance, the application filed for bring legal representative of Respondent No.5 on record is allowed. Delay, if any, stand condoned. Abatement, if any, is hereby set aside. Legal representatives of the Respondent No.5 are to be shown in the appeal and notices to be issued against them, in appeal. As against other respondents also, it appears that caveat was filed by Respondent No.6 and she is represented by one Advocate. Notice is made returnable on 28th June, 2016. 4.

As in the past the respondent Nos.5B to 5C were served through paper publication, notice to be issued against them in the news paper. Notice to be served on other Respondents by regular process.
