Heard in civil application No. 3200 of 2017. The Registrar (Judicial) of this court had dismissed the second appeal as against respondent Nos. 1B and 1D for failure to prosecute. The second appeal was admitted by this court and since copies of the appeal memo were not supplied, the notices were not issued to the respondent Nos. 1B and 1D. 2.

In view of above and for the reasons stated in the civil application, civil application is allowed in terms of prayer clauses "B" and "C" and disposed of.

In so far as the civil application No. 13693 of 2017 is concerned, issue notice to the proposed legal heirs of respondent No. 1B and 1D, returnable on 23.04.2018.
