It is apparent that, the Trial Court has accepted those LRs to be brought on record, who are mentioned in Application Exh.89 in MACP No.102/2006, by the impugned order dated 8.10.2015. The claim of the petitioners is that, besides the eight LRs brought on record, there are some more LRs, who have been left out. The petitioners had submitted their say at Exh.142 to the application Exhibit 89, without mentioning the names and specifications as regards those LRs who have been left out. So also an objection has been taken as against LR No.6.
{2} wp 8307.16.odt Learned counsel for the petitioners submits that he would prefer a proper application mentioning the details as regards the names, identity and the relationship of all such persons who amount to LRs of the deceased. He, therefore, prays for leave to withdraw this petition.
This petition, is, therefore disposed of as withdrawn with liberty to file a proper application within two weeks from today, mentioning the details as regards names, addresses and relations of such persons, who according to the petitioners would be the LRs of the deceased owner. Needless to state, if such an application is filed within two weeks, the trial Court may consider the same on its own merit. If such application is not filed within two weeks, that would amount to the petitioners having acquiesced of their right to file such application. (RAVINDRA V. GHUGE , J) vbd
