The petitioner is aggrieved by an interlocutory order dated 22/07/1996 delivered by the Industrial Court, Nasik in Complaint (ULP) No.643/1996, by which the respondents were granted interim protection. This Court had admitted the matter on 03/04/1997 and had stayed the impugned order. Said order is in force for almost 20 years.

I have heard the learned Advocates for the respective sides. Considering the above, I deem it proper to continue the interim order passed by this Court on 03/04/1997 for a period of 6 months so as to enable the Industrial Court, Jalgaon to decide Complaint (ULP) No.643/1996, if not already decided. If the said complaint is already decided, the parties would be subject to the result of the same and khs/NOV.2016/1230-d

further litigation, if any. Needless to state, if the complaint is not decided, the same shall be decided as per the directions set out herein and the interim order of this Court dated 03/04/1997 shall then merge in the final judgment of the Industrial Court. 3.

The petition is, therefore, partly allowed and Rule is made partly absolute.
