Considering the challenge made to the judgment and Award passed by the Reference Court and the fact that though, the S.L.A.O. has awarded compensation by treating

CA 2154.2017+.odt the land as agricultural land, the Reference Court has awarded the compensation @ Rs.75/- per square feet by considering the acquired land as a land having NA potential. The applicants are permitted to withdraw 25% of the amount deposited before this Court on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court, 25% of the amount on furnishing solvent surety to the satisfaction of the Registrar (J), 25% of the amount on furnishing Bank Guarantee of any Nationalized Bank, and remaining 25% of the amount shall be kept in Fixed Deposit Receipt in any Nationalized Bank initially for a period of five years and thereafter be renewed as per directions of this Court. 3.

Civil applications for withdrawal of the amount are accordingly allowed and disposed of.
