The petitioner is seeking premature release, however, his case is not being considered according to the guidelines. 2.

As can be seen from the circular issued by the Home Department (Prisons) under the Maharashtra Prisons (Review of Sentences) Rules 1972, dated 02.08.2004 a life convict who has completed 12 years of imprisonment, the Superintendent of Jail / Prison is supposed to initiate the steps for his premature release within the said guidelines.

It is being pointed out that the proposal sent by the Superintendent of Prison, Akola, and received by respondent no. 2 in May 2023, is still pending with respondent no. 2.

We dispose of the Writ Petition by directing respondent no. 2 to take appropriate decision on the petitioner's proposal in accordance with law as expeditiously as possible and in any case within a period of eight weeks.
