Applicants apprehend arrest in Crime No.484/2022, registered with Jintur Police Station, District Parbhani, for offence punishable under sections 353, 452, 323, 504, 506 r/w 34 of the Indian Penal Code.

FIR is lodged by Sainath Datta Torkad, Assistant at MSEDCL at Bhogaon, Taluka Jintur, District Parbhani, alleging that on 15/12/2022, at about 10:45 p.m. applicants manhandled and assaulted him with fists and kick blows saying that deliberately the electricity supply is disrupted.

Heard learned advocate for applicants and learned Additional Public Prosecutor for State. Perused the investigation papers.

It appears that due to the grievance of frequent disruption in electricity supply, applicants were agitated and that has resulted in the present incident.

Informant has not submitted himself for medical examination. Taking into consideration the allegations made in the FIR and role attributed to the applicants, nothing is to be recovered from them. Pre-trial custodial detention of applicants is, therefore, not necessary in the facts of the present case. 6.

In the result, application is allowed.

In the event of arrest of applicants in Crime No.484/2022, registered with Jintur Police Station, District Parbhani, for offence punishable under sections 353, 452, 323, 504, 506 r/w 34 of the Indian Penal Code, applicants be released on executing Personal Bond of Rs.15,000/- each, with one surety in the like amount.

Till filing of charge-sheet, applicants shall attend concerned police station on every Saturday and Sunday and cooperate in the investigation.

9.

Applicants shall not indulge themselves in similar offence and shall not tamper prosecution evidence. (NITIN B. SURYAWANSHI, J.)
