Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The evidence against the applicant is that he was found in possession the counterfeit currency notes. Therefore, the learned counsel for the applicant would submit that Section 489C of the Indian Penal Code would attract. The said section is bailable. Except this, no offence is made against him. Therefore, he may be granted bail.

The learned A.P.P. opposed the application. He would point out that the applicant was involved in the crimes. He is the resident of Degaon, Taluka Risod, District Washim. However, he has expanded his jurisdiction of crime. Though the offence is bailable, there is a great possibility of repeating the crime.

The recovery of the counterfeit currency notes was done at the instance of the accused. Considering the allegations levelled against the applicant, he may be granted bail on certain stringent conditions. Hence, the following order:- i) Application is allowed.

ii) Applicant Shivaji Ganpat Bhutekar be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in C.R.No.30 of 2021 registered with Kurunda Police Station, Hingholi, for the offences punishable under Sections 420, 417, 394, 489A, 489B, 489C, 120B, 170 and 506 of the Indian Penal Code, on the conditions that;

(a) He shall report, on first and last Tuesday of every month, to the Police Station Office, Risod, between 11.00 a.m. to 2.00 p.m., till the conclusion of the trial (b) He shall not leave the place of his residence i.e. village Degaon, Taluka Risod, District Washim, without intimation to Police Station, Degaon.
